Attorneys --- Where Are You On This??? 
Attorneys should be VERY concerned – but seem not to be -- on how DNA technology is NOT foolproof, based on the human factor – alone. WHY IS THIS??? I simply cannot think of any other issue that could be MORE important to address, than this one. This puts the integrity of our entire legal system in the balance, and our entire population and future at risk. This is particularly so in a few states such as Michigan. The only way to challenge these cases in court, is to have access to the actual electronic data and lab records --- where according to one legal expert (of whom I hesitate to name, at his request): “…In a few jurisdictions government labs have adamantly refused to disclose electronic DNA testing data, citing fears that defense counsel and their experts will misuse it. The Deputy Director of the Michigan State Police issued a statement on May 12, 2005 opposing “…the allowance of releasing raw electronic data for subsequent manipulations using software and parameters not validated by the Michigan State Police Forensic Laboratory…” and declaring that “…it is the position of the Michigan State Police Forensic Science Division that any release of this (sic) data for processing with non-validated parameters is tantamount to evidence tampering.” The claim that defense reanalysis of electronic data could, under any circumstances, amount to “evidence tampering” is absurd given that defense experts work only with a copy of the original data… The time is now ripe to continue the reform movement and help spread Professor Krane’s commitment to scientific openness to regressive jurisdictions like Michigan, where state officials continue to pursue policies designed to cloak the work of forensic laboratories in secrecy.” Let's notch this down one. Let's look at paternity DNA testing. Many states have a (pitifully low, in my opinion) threshold to meet to assume paternity. In Michigan, it's 99.99 percent. Some might think, "...wow - that's pretty close...". But think again. All humans share identical - yes, identical DNA up to 99.9%. If it is considered a match when meeting 99.99%, this is only a 1/10 difference. And so basically, meeting the state's 99.99% simply means that that 1 individual out of 10 others, is likely to be the true father --- and this is IF the test was reliably analyzed (with no oversights, convenient omissions, or other little ‘oopsies’, etc.). If there is only one individual's test data to analyze, guess who is really desirable for meeting the criteria. To put this in perspective then, using the 99.99% criteria - 10 individuals out of 100 would match (if they tested that many); 100 out of 1000; ... and so on. Unless someone can show me otherwise, we are ahead of ourselves in our technology. We have a powerful tool - and are using it very, very unwisely. So again - where are the attorneys? And why are they not challenging these abuses? God help us, if they don't step up to the plate, soon.

I too agree...why don't we have another lawyer stepping up to the plate to defend this man?  How do they disregard blood of one but not the DNA of this man?  If the blood of the 4 year old is thrown-out, so should any other evidence that graced the presence of the same lab in fear of cross-contamination. 

To the young lady that  is the niece of Ms. Mixer, where do you stand with this?  What about the rest of the family?  Who was with this man and what was his whereabouts during that time?  I'm sorry, I don't believe that this man has been proven guilty beyond a reasonable doubt.  I am not saying he's innocent, but I certainly don't feel he belongs behind bars and locked up based on what I have read, and have learned.  I strongly feel that neither families that have been effected by this tragedy have yet received their justification by our judicial system.
